People do have different opinions when it comes to medicines and reliefs. The issue regarding Marijuana and opiates has continued to be on the platform of controversy. Some people believe that these are remedies, but there are those that do not believe on the benefits they give.

DEA and FDA are two of the most powerful agencies having powers granted by the State to regulate and set up criteria regarding scheduling of drugs and medicines. In 2016, it was believed that the Drug Enforcement Administration or DEA placed a temporary ban on kratom. The agency received a backlash with Marijuana, but it has continued until they reclassified kratom as Schedule I drug.

The reaction shown by people is more intense and strong with Kratom. In fact, there have been public demonstrations, calls by Congress, and petitions to at least overrule the DEA’s decision. Because of such events, DEA withdraws its notice of intent in October 2016 to initiate the emergency scheduling and to ask public comment further regarding its active ingredient.

To those who do not understand what scheduling of drug means, all you need to remember is its extent. Authorities and agencies set criteria whether or not they belong to each other or they have similar effects, or they are similarly situated with each other.

When an authority speaks of Schedule 1 drug, it simply means that there are no currently acceptable or proof of potential abuse or medicinal use. When experts say it is classified as an emergency, it means that the agency is still gathering additional information to determine if they will temporarily or permanently ban the strain.

According to DEA, they use the Eight Factor Test in order to determine and thereafter the placing of the drug in a schedule. The Eight Factor Test includes details regarding the drug’s pharmacology, risks, and abuse potential. The agency should consider 3 out of eight factors to schedule the substance temporarily.

  • The history of substances and present abuse pattern
  • The risk to public health and wellness
  • The Duration, Scope, and Abuse Pattern

Additionally, the agency considers the actual abuse, distribution and  manufacture potential, and clandestine importation of the drug. The active ingredients have broad variability, and this may cause unpredictable effects. This is the concern of the agency.

Before anything else, you should have a little glimpse of what kratom is all about. Its powder was originated from the tree called Mitragyna Speciosa which grows in different countries of Southeast Asia like Malaysia, Thailand, and Indonesia. When ingested, the leaves will give the effects such as enhancing mood, relieving pain and managing anxiety.

According to the proponents of such strain, the powder form of kratom has helped them transformed their lives into a better one. In fact, they thanked kratom a lot because the strain has helped them obtain energy and rest from pain. The people who are in favor of kratom believe that negatives effects on the brain are not true because no proof or research are saying this.

For recreational purposes, kratom has been accepted but not with medicinal , and this is the point of view of FDA, It makes sense that the agency did not approve or recommend this strain. For some reason, consumers know better when it comes to the commodities good for them than the state or government.

Some people also point out that kratom powder is safe because thousands of people have used it for decades. Even without approval from the government, people claimed that a lot of ailments had been managed.

The question regarding the legality of kratom in the state varies. There are a lot of states and countries that have different opinions. In the US, not all states treat or classify kratom as legal, IN fact, six of them banned the kratom. Until now, the ban has been lifted.

Kratom: The Current Legal Status of Every State

Patient experience plays a huge role when it comes to therapeutic effects. When it comes to the clinical research, the strain is non-existent. In fact, there are no substantial data available online  since 2012. The strain provides a combination of sedating and stimulating effects that differ according to the nature of the strain as well as the dosage.

The Kratom’s active ingredients are (7-HMG) 7-hydroxumitra-genuine and mitragynine. They have shown to possess analgesic and anti-inflammatory properties. These two ingredients act as agonists to receptors, specifically opiate receptors.

According to DEA, they are about to reveal a final decision of Kratom’s legal status because until now; the status is still unknown. Unfortunately, its present legality remains a gray subject matter for some people. Currently, the legal status of kratom in the United States varies. There are those that treat as legal, but there are few that banned its use and possession.

The states mentioned below have already banned or is about to ban kratom:

On May 10, 2016, Kratom was classified as Schedule 1 controlled substance drug in Alabama.

On February 2016, Kratom was classified as controlled substance in Arkansas.

In California, the entire cities classify Kratom as legal with the exception of San Diego. The latter city passed a local ordinance banning kratom.

Except Sarasota County, Kratom is classified as legal in the state of Florida.

In Illinois, the rules vary. For the entire state, it is classified as legal. However, the sale to minors of the strain is illegal in Jerseyville.

In Indiana, the strain is banned as it is scheduled as a form of synthetic drug.

In New Hampshire, the strain is classified as legal for those 18 years old and above.

In Rhode Island, Vermont, and Wisconsin, the strain is totally banned.

In Tennessee, there was ordinance passed treating or classifying kratom as legal.

As soon as the FDA treated kratom as an opioid drug, researchers wrote a letter to Robert Patterson who has been the working as an DEA administrator. Thereafter the topic about crisis has been brought up. The people warned them that banning or treating or classifying kratom as illegal would worsen the situational crisis. People who would turn to strain for withdrawal treatment or pain relief might resort to opioids.
